Liability Waiver

As a condition of my participation in the American Physiology Summit (this “Event”), I agree to the terms contained herein and hereby waive any claim I may have against the American Physiological Society (“APS”) and its officers, directors, employees, or agents, or against the presenters or speakers (collectively, with APS, the “APS Releasees”), for reliance on any information presented and release the APS Releasees from and against any and all liability for damage, loss or injury that may arise from my participation or attendance at the program. If another individual participates in my place per APS transfer policy, the new registrant agrees to this disclaimer and waiver by default of transfer.

I acknowledge that there may be risks and dangers not known to me or APS or not reasonably foreseeable at this time. I further acknowledge that there may be risks and uncertainties inherent in participating in the Event, including but not limited to injury, illness, death and/or and damage to person or property due to the negligent acts or omissions of APS Releasees and/or others. These risks may be caused by a lack of mitigation measures, my negligence or the negligence or inaction of others, or other reasons beyond the control of any single party or actor, including APS and their respective sponsors, exhibitors, officers, directors, employees, agents, trustees, representatives, and contractors in their official and individual capacities.

I further understand and agree that all property rights in the material presented, including common law copyright, are expressly reserved to the presenter or speaker or to APS.

I understand that the conditions surrounding the Event and related travel may expose me to mental, emotional, and physical stress or serious injury or illness (including death), both during and after my participation.  I acknowledge that participation in the Events and activities brings some risk and I do hereby assume responsibility for my own well-being.

I understand that travel and gathering involves risk of sickness, including sickness from COVID-19. I (and on behalf of my guest(s)) waive and release the APS Releasees, and APS’s sponsors and exhibitors, and their employees and agents, from and against all claims, liabilities, losses, and expenses arising from injury, sickness or death from contraction or spread of COVID-19 and other communicable disease due to travel to or attendance at the Event. I further understand and agree that APS does not owe any obligation, financial or otherwise, to myself or my dependents, heirs, executors, administrators, and assigns, for any costs incurred, including testing, medical treatment, travel, or a refund of registration, in the instance I contract COVID-19 or other communicable diseases prior to, during, or as a result of my attendance and participation in the Event.

I will take the necessary precautions while at the Event including, but not limited to, engaging in appropriate social distancing, wearing a mask when requested and/or required, minimize face touching, frequently washing hands and avoiding risky environments such as overcrowded bars or restaurants. I agree not to attend any APS events if I feel ill or had recent exposure to a COVID-19 case. I understand that policies related to the spread of COVID-19 are constantly changing, and agree to abide by the safety laws, rules, and regulations as well as any APS or Event Venue policy in effect during the Event related to the prevention of the spread communicable diseases, including COVID-19.

I agree that this Agreement is to be construed and interpreted under the laws of the State of Maryland excluding its conflicts of laws rules, and is intended to be as broad in scope and applicability as permitted by law.  I agree that any legal action or proceeding will be brought exclusively in the federal or state courts located in the State of Maryland, and I irrevocably consent to the personal jurisdiction and venue therein.

By consenting to the terms contained herein, I hereby acknowledge that I have read this entire document, that I understand its terms, and that by signing it I am giving up substantial legal rights I might otherwise have, and that I have signed it knowingly and voluntarily.  I hereby waive all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, and I further waive all rights to have damages multiplied or increased. This waiver and release is binding on me and my dependents, heirs, executors, administrators, and assigns.  When used herein, the term “including”, and words of like import are deemed to be followed by “without limitation.”
